Cesium Events Terms of Service

Cesium Events is a native macOS app published by Jucius Labs ("we", "us"). These Terms of Service ("Terms") describe the agreement between you and Jucius Labs when you install or use Cesium Events. By installing or using the app, you agree to these Terms. If you do not agree, please do not install or use the app.

Cesium Events is distributed exclusively through the Mac App Store. Your download, payment, refund, and license relationship with Apple is governed by Apple's Licensed Application End User License Agreement ("Apple EULA") and the Apple Media Services Terms. These Terms supplement that agreement. Where Apple's terms conflict with anything below, Apple's terms control with respect to distribution, payment, and the platform license.

License

Jucius Labs grants you a non-exclusive, non-transferable, revocable license to install and use Cesium Events on Mac computers that you own or control, subject to the Apple EULA and to these Terms. You may use the app for any lawful personal or business purpose. You may not redistribute the app, sublicense it, or sell access to it.

You may not copy, modify, decompile, reverse-engineer, or attempt to derive the source code of Cesium Events, except to the extent that such restriction is expressly prohibited by applicable law.

Free trial and purchase

Cesium Events includes a 7-day free trial that begins on first launch. During the trial, all features are available. After the trial expires, full-screen pre-meeting notifications stop firing and the menu-bar dropdown replaces the agenda with a "Trial Expired" card until you purchase the app or restore a previous purchase.

Cesium Events is sold as a one-time, non-consumable in-app purchase ("Full Version"). There is no subscription. The purchase is processed by Apple through StoreKit. The price shown in the Mac App Store at the time of purchase is the price you pay. Family Sharing is supported, subject to Apple's rules.

Refunds

All purchases are processed by Apple. Refund requests are handled by Apple under its standard refund policy at reportaproblem.apple.com. Jucius Labs cannot directly issue refunds for Mac App Store purchases.

Your accounts and credentials

You are responsible for the calendar accounts you connect to Cesium Events and for keeping your Mac secure. By connecting a Google or Microsoft account, you authorize Cesium Events to read calendar data from that account using the read-only OAuth scopes described in the Privacy Policy. You may revoke that authorization at any time, either inside Cesium Events (Settings → Accounts → Disconnect) or through the provider's account-management page.

You agree not to use Cesium Events to access calendar data you are not authorized to access, and not to use it in a way that violates the terms of service of Apple, Google, or Microsoft.

When you connect a Google account, your use of Google Calendar is governed by Google's terms, including:

Jucius Labs is not responsible for the availability, accuracy, or content of any third-party calendar service. If a provider's API changes, becomes unavailable, or rate-limits the app, Cesium Events may show fewer events or may temporarily fail to sync.

Privacy

The Cesium Events Privacy Policy describes exactly what data the app reads, where that data lives, and which network hosts the app contacts. The Privacy Policy is incorporated into these Terms by reference.

Acceptable use

You agree not to:

  • Use Cesium Events to engage in unlawful activity or to infringe the rights of others
  • Attempt to interfere with, disrupt, or probe the security of the app, the Mac App Store, or any third-party calendar provider
  • Use the app to send spam, malware, or unsolicited communications, or to harvest information about other users of any connected service
  • Remove, obscure, or alter any proprietary notice or label included in the app

Updates and changes to the app

Cesium Events is updated from time to time through the Mac App Store. Updates may add, change, or remove features. We may discontinue any feature, integration, or version of the app at our discretion. Where reasonable, we will give advance notice of material changes that affect paid functionality.

Disclaimer of warranties

Cesium Events is provided "as is" and "as available", without warranty of any kind, express or implied, including (but not limited to) warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that every notification will be delivered on time. You should not rely solely on Cesium Events for any event whose miss would cause harm, loss, or liability. Calendar data is supplied by third parties (Apple, Google, Microsoft) and may be incomplete, delayed, or inaccurate.

Limitation of liability

To the maximum extent permitted by law, Jucius Labs and its owners, employees, and contributors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of (or inability to use) Cesium Events, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or related to these Terms or the app will not exceed the amount you paid Apple for the app in the twelve months preceding the claim, or, if no payment was made, ten US dollars (USD 10).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the smallest amount permitted by law.

Indemnification

You agree to indemnify and hold harmless Jucius Labs from any claim, demand, or damages (including reasonable attorneys' fees) arising out of your misuse of Cesium Events, your violation of these Terms, or your violation of any third-party right, including the terms of service of Apple, Google, or Microsoft.

Termination

You may stop using Cesium Events at any time by uninstalling it. Doing so removes locally stored preferences, OAuth tokens, calendar-list cache, and account metadata, as described in the Privacy Policy. We may suspend or terminate your license if you materially breach these Terms. Sections that by their nature should survive termination (License limits, Disclaimer, Limitation of Liability, Indemnification, Governing Law) survive.

Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top will reflect the current version. Material changes will be highlighted on the Cesium Events page on this site. Your continued use of Cesium Events after a change becomes effective means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the United States and the State of Massachusetts, without regard to its conflict-of-law principles. The exclusive venue for any dispute that cannot be resolved informally is the state or federal courts located in Massachusetts, except where applicable consumer-protection laws give you the right to bring a claim in your local courts.

Apple-specific terms

You acknowledge that these Terms are between you and Jucius Labs only, not with Apple. Apple is not responsible for Cesium Events or its content. Apple has no obligation to provide maintenance or support for Cesium Events. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) you paid for it. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Cesium Events. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce these Terms against you. The Apple EULA and Apple Media Services Terms govern any conflict regarding distribution, billing, refunds, and platform usage.
